La transazione e figure affini. Profili comparatistici

Abstract

Il contributo prende in esame la complessa ed interessante figura della transazione, ovvero quel contratto attraverso il quale le parti, facendosi reciproche concessioni, pongono fine ad una lite già incominciata, o prevengono una lite che può sorgere tra loro. Muovendo dalle origini storiche, sono stati analizzati la natura e gli elementi essenziali dell'istituto per poi esaminare le figure affini, ovvero strumenti alternativi di risoluzione delle controversie senza ricorso all'Autorità Giudiziaria, evidenziando differenze ed affinità tra gli stessi, anche attraverso rilievi comparatistici con gli ordinamenti francese e spagnolo.

The contribution examines the complex and interesting figure of the transaction, that is that contract through which the parties, by making mutual concessions, put an end a dispute that has already begun, or prevent a dispute that may arise between them. Starting from the historical origins, the nature and essential elements of the institution were analyzed and then similar figures were examined, that are alternative instruments for resolving disputes without recourse to the Judical Authority, highlighting differences and affinities between them, also through some comparative insights with the French and Spanish legal systems.
